I have elected to voluntarily participate in the East Bay AIDS Walk. I understand and acknowledge that my participation in this activity may involve certain risks, including the possibility of serious bodily injury, and that by participating; I assume all risks and hazards associated with the activity. If I am a East Bay AIDS Walk employee, I also acknowledge that this is a non-work activity and any injury or losses resulting from my participation in this voluntary activity will not be covered by workers’ compensation laws of this state. In addition, I consent to the use by East Bay AIDS Walk including its agents, assigns and licensees of my name, photo, likeness or film, videotape and/ or sound recording of me (collectively, hereinafter referred to as the “Information”) to promotion or publicize East Bay AIDS Walk business both internally and externally, worldwide in any media whether now known or hereafter devised. I expressly disclaim all rights to all values and benefits East Bay AIDS Walk may gain through the use of the Information. In consideration for being allowed to participate, I do hereby waive all rights and release East Bay AIDS Walk, its agents, officers, employees, affiliates, subsidiaries, successors, and all non-profit organizations, and their parent organizations, associated with this event, and assigns, both past and present, from any and all claims, causes of action, or other liabilities that may arise from or be related in any way to my participation in this activity and/ or any use of my Information. I further agree to hold Starbucks and all non-profit organizations, and their parent organizations, associated with this event harmless for all injuries, damages, or losses arising out of my participation. I further state that I am eighteen (18) years of age or older; am legally competent to sign this waiver and release; have carefully read this waiver and release; and have signed it as my free and voluntary act and deed.
